This Update

June Legislative Update

None of the bills that could affect ProDoc forms have been signed by the Governor in time to meet our production deadline for the June CD shipment. However, you will receive a WebUpdate from us, as soon as possible, for any new legislation that is signed and becomes effective July 1, 2011. That WebUpdate will not install until you have first installed this CD update.

Depending on which bills are signed, the enhancements in this mid-year update cycle may include:

  • Family Law – We are updating the alimony provisions in 17 petitions and judgments pursuant to HB 1111, which requires clear and convincing evidence before awarding permanent alimony following a marriage of moderate duration. Further, it requires written findings of exceptional circumstances in an award of permanent alimony following a marriage of short duration. The bill also requires a finding that no other form of alimony is fair and reasonable before permanent alimony can be awarded, and that an award of alimony may not leave the payor with significantly less net income than the net income of the recipient unless there are written findings of exceptional circumstances.
  • We are also updating the petitions and judgments for injunctions for protection against repeat violence, dating violence, and sexual violence, pursuant to HB 240. This bill adds circumstances that violate these types of injunctions to bring them more in line with injunctions against domestic violence.

  • Litigation - We are updating the judgments to comply with HB 567 by specifying the post-judgment interest rate and stating that it shall be adjusted annually on January 1 of each year in accordance with the interest rate in effect on that date as set by the Chief Financial Officer.

Coming Updates

September - We will provide you, via a CD update, the 2011 legislative update for new legislation effective October 1, 2011.

Recent WebUpdates

We released the following WebUpdates since March this year:

  • Business Transactions Solution - We completely re-organized this volume. The form selector numbers and links to Westlaw were changed to match the updated source material. We also removed two forms that were no longer available.
  • Criminal Law - We added 22 new circuit court forms from the Eighth and Thirteenth circuits. We also added hyperlinks to Westlaw analytical links where applicable on form information screens.
  • Family Law - We added six new Florida Supreme Court forms pertaining to temporary or concurrent custody by an extended family member. Modified two non-Supreme Court forms relating to the same type of action.
  • Landlord/Tenant - We added hyperlinks to Westlaw analytical links where applicable on form information screens.
  • Lipman's Wills & Trusts - We added language in several irrevocable trusts when the trust has an SNT beneficiary.
  • Mortgage Foreclosure - We added hyperlinks to Westlaw analytical links where applicable on form information screens.
  • Certified Mailer - We updated the postage fees in April for the 2011 USPS postal rate increase.

Q: Staff members advise that the HUD-1 form in ProDoc is not user friendly. It appears that you can go through the motions to fill out the form, however, you are not able to save it in a format in which you can go back to make changes and have it recalculate. The form is saved in a .pdf format. When changes have to be made, they have to re-enter ALL of the information again. Are they not using the program properly or is this correct? If this is correct, can ProDoc fix this issue?

Q: I saw that ProDoc is available in 64-bit, but it’s installed on my server and running in 32-bit mode. How do we get the 64-bit version? When we install it, will it automatically uninstall the 32-bit version and install?

Q: When I opened the list of family law forms, it does not include any 2nd Circuit forms; much less any of the newly added 7 forms in the most recent update. Can you please fill me in on where the seven newly added 2nd Circuit forms are found?

Q: There is a Petition to Waive Bond of Personal Representative, and also a Waiver of Bond by and Interested Party, but no Order Waiving Bond of Personal Representative. Any idea why there is no Order?

Prevent ProDoc Time-Outs
Your ProDoc presently will time-out on September 29, 2011, if you do nothing to extend it. By installing the June update from the CD you will receive in a few days, the time-out date will be extended until June 30, 2011.
