Updates Review

This Update

This shipment includes a roll-up of all WebUpdates since the last CD update, as well as new revisions. The changes in this shipment include:

  • Attorney Client Matters – We revised Form 3-115, Attorney Fee Agreement - Contingency Cases - Form A, and added new Form 3-116, Contingent Fee Agreement - Form B, in accordance with the amendment to Massachusetts Rule of Professional Conduct 1.5 ordered by the Supreme Judicial Court.
  • Family Law – We updated the Request for Copy of Tax Return (IRS Form 4506) and Request for Transcript of Tax Return (IRS Form 4506-T) pursuant to an agency revision of those forms. And, we updated 12 UIFSA forms. These included the National Medical Support Notice and the Order or Notice to Withhold Income for Child Support, which were updated pursuant to revisions by the U.S. Dept. of Health and Human Services.
  • Lipman’s Wills & Trusts – We added language in several irrevocable trusts when the trust has an SNT beneficiary.
  • Litigation – We revised Form 3-115, Attorney Fee Agreement - Contingency Cases - Form A, and added new Form 3-116, Contingent Fee Agreement - Form B, in accordance with the amendment to Massachusetts Rule of Professional Conduct 1.5 ordered by the Supreme Judicial Court. We also updated the Request for Copy of Tax Return (IRS Form 4506) pursuant to an agency revision of the form.
  • Probate – We updated Form 1-161, Application for Copy of Death Record, pursuant to a revision of the form by the Massachusetts Dept. of Health and Human Services.
  • Real Estate – We updated Form 8516, Declaration of Homestead (REBA No 16), Form 8-518, Declaration of Homestead Elderly or Disabled Person (REBA No 17), and Form 8-520, Release of Declaration of Homestead (REBA No 34), by adding optional signature for non-titled spouse or owner spouse in accordance with legislative revisions to the declaration of homestead in SB 2406. We also updated Form 7-105, Petition for New Certificate after Death, an official Mass Land Court form. Finally, we added six new forms pursuant to an update by REBA (The Real Estate Bar Association of Massachusetts) pursuant to the new Massachusetts Homestead Act.
  • Business Transactions Solutions - We completely re-organized this volume. The form selector numbers and links to Westlaw were changed to match the updated source material. We also removed two forms which were no longer available.

Q: Staff members advise that the HUD-1 form in Westlaw Forms is not user friendly. It appears that you can go through the motions to fill out the form, however, you are not able to save it in a format in which you can go back to make changes and have it recalculate. The form is saved in a .pdf format. When changes have to be made, they have to re-enter ALL of the information again. Are they not using the program properly or is this correct? If this is correct, can Westlaw Forms fix this issue?

Q: I saw that Westlaw Forms is available in 64-bit, but it’s installed on my server and running in 32-bit mode. How do we get the 64-bit version? When we install it, will it automatically uninstall the 32-bit version and install?
