My client entered into an executory contract to sell real property to buyer. The contract is for a downpayment amount of $4,000.and 40 monthly payments at 8.00% fixed interest. Buyer paid the down payment and total 8 months payment, and has refused to pay anymore for the past 8 months.Seller wants to get buyer off property.
The contract contains a clause that gives seller the power to foreclose without notice after 2 months delinquency.
I propose to give buyer a 30 day notice, followed by forfeiture of paid being rent for period of occupancy. Is this the best legal action available, and what legal processess are available to get him off the property?
