Massachusetts Real Estate Volume

The Real Estate volume contains a wide assortment of easy to use forms covering most common situations.  There are more than 230 automatic but very flexible forms in all, many of which offer multiple options about the language to include.  The result is that Westlaw Forms can be used to create hundreds of different custom crafted documents in very short order.  Information is shared across documents, so that the buyer names you enter in a purchase agreement are offered to you as the borrower names in a note and mortgage, and if an acknowledgment or jurat is needed on a form, it is automatically added to the form you’ve drafted with the names already completed.

Client Matters and General Correspondence
The correspondence forms in this volume help you comply with communications and conflict of interest rules in the Attorney Rules of Professional Conduct. Of particular value are the Letter of Engagement and Letter to Avoid Conflicts of Interest. Also included are a variety of letters to different parties, most of which offer a wide variety of options and outputs.

Property Transfers
This section covers the transfer of property beginning with the Offer and concluding with the Deed.

It includes the Real Estate Bar Association Offer to Purchase and Purchase and Sale Agreement, also a commercial purchase and sale agreement, and a variety of common riders, including the Lead Paint notice and the timely Addendum for Short Sale. There are a variety of deeds, plus bills of sale for personal property involved in the transaction. Also included are escrow forms plus a variety of easements which may be helpful after the sale.

Lending
Included in this section are promissory notes and mortgages, including FNMA forms, security agreements and UCC forms, HUD-1 forms, and an assortment of related forms, including mortgage assignment, mortgage discharge, and partial release of a mortgage.

The section on defaults includes a number of notices for free standing real estate and condominiums.

It also includes the FNMA Homesaver Advance Disclosure Statement and Promissory Note for workout situations with loans in default.

Construction
This section contains forms for construction lending, as well as mechanics liens. Included in the first group are the FNMA Multistate Construction Contract, and the FNMA Construction Loan Agreement.

Leasing
There are leases ranging from single family residential property to a commercial lease, also a very flexible sublease. Other forms range from a guaranty of tenant's obligations, an assignment of lease, and an affidavit of compliance with right of first refusal. And, of course the Massachusetts Lead Based paint Disclosure for Leases is a part of the package.

Fifteen different Land Court forms from the Civil Cover Sheet and Petition for New Certificate after Death down to the Attorney's Certificate for Amendatory Mortgages provide for a balanced package of commonly used forms.

The Real Estate volume concludes with 41 miscellaneous forms, ranging from the non-foreign seller affidavits required by Federal Law to the Massachusetts Department of Revenue Application for Certificate Releasing Massachusetts Estate Tax, together with the related Nonresident Decedent Affidavit and Certificate Releasing Massachusetts Estate Tax Lien. The offering includes commonly used affidavits and agreements needed to hold the deal together from those little issues that always seem to arise near the end.
